This Privacy Policy describes how Profit First LLC ("we", "us", or "our") collects, uses, and shares information about you when you use our mobile application Retro AI ("App").

By using the App, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

1.1 Photos and Images

When you use our photo restoration features, you upload photos directly within the App. These photos are temporarily transmitted to our third-party AI processing provider (KIE AI, operated by Red Panda AI) solely for the purpose of generating your requested restoration result. Photos are not stored permanently on our servers and are not used for any other purpose, including advertising, profiling, or AI model training.

1.2 Usage Data

We collect anonymous usage data through Mixpanel, a third-party analytics provider. This includes information such as:

  • Which features you use within the App
  • How you navigate through the App
  • General app performance data
  • Anonymous device identifiers

This data is collected anonymously and cannot be used to identify you personally. It is used solely to improve the App's features and performance.

1.3 Purchase Information

When you subscribe to Retro AI Premium, your payment is processed entirely by Apple through the App Store. We do not collect, store, or have access to your payment card information. We receive only confirmation of your subscription status through RevenueCat, our subscription management provider.

1.4 Device Information

We may collect basic device information such as:

  • Device type and operating system version
  • App version
  • Anonymous device identifier

2. How We Use Your Information

We use the information we collect to:

  • Provide and improve the App's photo restoration features
  • Process your photos through our AI restoration technology
  • Manage your subscription and provide customer support
  • Analyze usage patterns to improve App performance and features
  • Send important notifications related to your subscription

We do NOT use your information to:

  • Display third-party advertisements
  • Sell your data to third parties
  • Build advertising profiles
  • Track you across other apps or websites

3. Third-Party Service Providers

We work with the following third-party providers to deliver our services:

3.1 KIE AI (Red Panda AI)

Purpose: AI photo restoration processing
Data shared: Photos you upload for restoration
Data retention: Photos are processed and returned immediately; not stored permanently

Purpose: Subscription management and in-app purchase processing
Data shared: Anonymous user identifier and subscription status

4. AI Processing and User Consent

Our App uses artificial intelligence technology provided by KIE AI (Red Panda AI) to process your photos. This AI is not built in-house by Profit First LLC.

When you use any restoration feature in our App:

  • Your photo is securely transmitted to KIE AI's servers via encrypted connection (HTTPS)
  • KIE AI processes your photo to generate the restoration result
  • The restored photo is returned to the App and displayed to you
  • Your original photo and the restored result are not permanently stored on KIE AI's servers after processing is complete
  • Your photos are not used to train AI models

You provide explicit consent to this process during the App's onboarding flow, where you are clearly informed about how your photos are processed before you can use any features.

5. Data Security

We take the security of your data seriously. All data transmitted between the App and our service providers is encrypted using industry-standard HTTPS/TLS protocols. We do not store your photos on our own servers.

6. Data Retention

  • Photos: Not stored permanently. Transmitted for processing and immediately discarded after the restoration result is returned.
  • Usage Analytics: Anonymous usage data is retained by Mixpanel for up to 36 months.
  • Subscription Data: Retained by RevenueCat for as long as your account is active and as required by law.
  • Local App Data: Restoration history is stored locally on your device only and is deleted when you uninstall the App.

7. Children's Privacy

Our App is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at profitfirstllc@gmail.com.

8. Your Rights

Depending on your location, you may have the following rights regarding your data:

  • Right to Access: Request information about what data we hold about you
  • Right to Deletion: Request deletion of your data
  • Right to Correction: Request correction of inaccurate data
  • Right to Object: Object to certain types of data processing
  • Right to Data Portability: Request a copy of your data

9. California Privacy Rights (CCPA)

We do not sell your personal information.

10. GDPR (European Users)

If you are located in the European Economic Area (EEA), you have certain rights under the General Data Protection Regulation (GDPR). Our legal basis for processing your data is:

  • Contractual necessity:To provide the App's features you request
  • Legitimate interests: To improve our App through anonymous analytics
  • Consent: For AI processing of your photos, obtained during onboarding

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any significant changes by updating the "Last updated" date at the top of this policy. Your continued use of the App after any changes constitutes your acceptance of the updated policy.
