Please read these Terms and Conditions ("Terms") carefully before using the Retro AI mobile application ("App") operated by Profit First LLC ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the App.
1. Acceptance of Terms
By accessing or using Retro AI, you confirm that you are at least 13 years of age, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations.
2. Description of Service
Retro AI is an AI-powered photo restoration application that allows users to restore, colorize, enhance, and modify old or damaged photographs using artificial intelligence technology. The App provides the following features:
- Restore Old Photos
- Colorize Black & White Photos
- Enhance & Sharpen Photos
- Remove Scratches & Stains
- Lighting Correction
- Photo Combining
3. Subscription and Payment
3.1 Free Trial
Retro AI offers a 3-day free trial period for new subscribers. During the trial period, you have access to all premium features. Trial access includes a maximum of 2 photo restoration processes.
3.2 Subscription Plans
After the free trial, the following subscription plans are available:
- Weekly Plan: $9.99 per week
- Yearly Plan: $99.99 per year (equivalent to $1.92 per week)
3.3 Billing
Payment will be charged to your Apple ID account upon confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
3.4 Cancellation
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods.
3.5 Price Changes
We reserve the right to modify subscription prices with reasonable notice. Continued use of the App after price changes constitutes acceptance of the new pricing.
4. User Content and Photos
4.1 Your Content
You retain all ownership rights to the photos you upload to the App. By uploading photos, you grant us a limited, temporary license to process your photos using our AI technology solely for the purpose of providing the restoration service you requested.
4.2 Content Restrictions
You agree not to upload photos that:
- Depict illegal content of any kind
- Contain nudity or sexually explicit material
- Violate the privacy or rights of others
- Infringe on any third-party intellectual property rights
- Contain harmful, threatening, or abusive content
4.3 Content Responsibility
You are solely responsible for the photos you upload. We do not monitor user-uploaded content but reserve the right to remove content that violates these Terms.
5. Intellectual Property
5.1 App Ownership
The App, including its design, features, code, and content (excluding user-uploaded photos), is owned by Profit First LLC and protected by applicable intellectual property laws.
5.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.
5.3 Restrictions
You may not:
- Copy, modify, or distribute the App or its content
- Reverse engineer or attempt to extract the source code
- Use the App for any commercial purpose without our written consent
- Remove any copyright or proprietary notices
6. AI-Generated Content
6.1 Nature of Results
The restoration results produced by our App are generated by artificial intelligence. While we strive for high quality, we cannot guarantee that AI-generated results will be perfect, accurate, or meet your specific expectations.
6.2 Ownership of Results
The AI-restored photos generated through the App are provided to you for your personal use. You may use, share, and print these restored photos for personal purposes.
6.3 No Warranty on Results
We make no representations or warranties regarding the accuracy, quality, or suitability of AI-generated restoration results for any particular purpose.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or other harmful components
- The results of using the App will meet your requirements
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFIT FIRST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER LOSSES ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy.
10. Third-Party Services
The App uses third-party services including KIE AI for photo processing, RevenueCat for subscription management, and Mixpanel for analytics. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.
11. Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without cause, with or without notice, effective immediately, particularly if you violate these Terms.
Upon termination:
- Your right to use the App will immediately cease
- Any data stored locally on your device will remain until you delete the App
- No refunds will be provided for any unused subscription period
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the United States.
13. Apple-Specific Terms
The following terms apply to your use of the App obtained through the Apple App Store:
- These Terms are between you and Profit First LLC, not Apple Inc.
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any claims relating to the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price
- Apple and its subsidiaries are third-party beneficiaries of these Terms
- Apple's usage rules as set forth in the App Store Terms of Service apply to your use of the App
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
